SUNK, STRANDED OR ABANDONED VESSELS Former MFV ‘Ros Min’ Section 252 of the Merchant Shipping Act 1995 Cornwall Council (“the Council”) has exercised its powers under section 252 of the Merchant Shipping Act 1995 and article 60 of the Cornwall Harbours Harbour Revision Order 2023 in respect of ‘Ros Min’ which has sunk in Newquay Harbour at South Quay (“the Vessel”).
The Council has exercised its powers in an emergency and taken possession of the Vessel. It is now in the process of raising, removing and destroying the Vessel and any other property to which its powers extend. Under article 60 of the Cornwall Harbours Harbour Revision Order 2023, any expenses reasonably incurred by the Council in relation to the Vessel under section 252 of the Merchant Shipping Act 1995 are recoverable from the owner of the Vessel.
