NOTICE OF INTENTION TO SELL, BREAK UP OR OTHERWISE DISPOSE OF A VESSEL

NOTICE IS HEREBY GIVEN that Cornwall Council (‘the Council’) as statutory harbour authority for Newquay Harbour intends to exercise its powers under article 61 of the Cornwall Harbours Harbour Revision Order 2023 (“the 2023 Order”) to sell, break up or otherwise dispose of the vessel, Saxon Mist (“the Vessel”), which is in an unserviceable condition and has been laid by or neglected in Newquay Harbour.

Following the expiration of the period 14 days after the date at the foot of this notice i.e. after 8 May 2024, the Council will sell, break up or otherwise dispose of the Vessel and retain from the proceeds of sale any expenses reasonably incurred by it in respect of the Vessel (and any expenses incurred under section 57 of the Harbours, Docks and Piers Clauses Act 1847). If the proceeds of sale are insufficient to reimburse the Council, or if there is no sale, the Council may recover the deficiency, or where there is no sale the whole of the expenses, from the owner as simple contract debt.

Any person who is the owner of the Vessel should confirm ownership in writing to the harbour master, Kimberley Johnson, by email at kimberley.johnson@cornwall.gov.uk or by post to Newquay Harbour Office, South Quay, Newquay, Cornwall, TR7 1HR. Any such response should be received by the harbour master before the expiry of a period of 14 days starting with the date at the foot of this notice.
